Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees.  Specifically,
A close proximity operated, electromagnetic, below-the-hook lifting device
was not
operated, inspected, and maintained properly to ensure the safety of the
operator or other
employees at the parts washer in the Press Area. This included:
a)Marking of rated load capacity with a reference to the instruction manual
for information relating to decreases in rating due to the load surface
condition, thickness, percentage of contact with the magnet, temperature,
metallurgical composition, and deflection were not present or were
illegible.
b)Operators of these electromagnetic lifting devices had not been
instructed
in the safe use of these lifters and their limitations, including
conditions,
load characteristics and factors that affect the lifting capacity or the
safety
of employees. Operators were permitted to operate these lifters before
receiving this instruction and demonstrating their ability to operate the
lifter as instructed. Copies of the Operator's Manual and Safety
Instructions were not readily available to the operators who were
unfamiliar with the manual or the safety instructions provided.
c)The electromagnetic lifting device had not received frequent inspections
at least monthly, nor a complete periodic inspection at least annually with
dated inspection reports and records. The lifting device at the parts
washer
had a severely deteriorated or damaged synthetic encapsulation on the
electrical coil, and it did not have the labels necessary to inform the
operator of the rated load capacity or safe operating considerations.
Abatement Guidelines: Comply with American National Standards Institute
Standard
B30.20 for Below-the-Hook Lifting Devices, and the manufacturer's
recommendations,
including those contained in the Operator's Manual and Safety Instructions
with
Inspection and Maintenance Instructions publication for this lifting
device, or equivalent.
