Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On and prior to 8-24-99 employees were exposed to serious burns from erupting molten metal from the Inductotherm induction furnaces whenever the furnaces' instrumentation showed eratic readings signalling the presence of serious problems, such as but not limited to molten metal coming into contact with the cooling coils, i.e., water. Among other methods, the following are feasible and acceptable methods to minimize the probability of molten metal eruption due to molten metal coming into contact with the furnaces' cooling coils: 1. Develop monitoring procedures for furnace condition in the form of inspections of the refractory material, careful measuring of the thickness of the refractory lining, repair of the top cap of the furnace refractory, careful tracking of the types of heats to which the furnaces are subjected so as to make a determination as to the approximate life expectancy (number of heats) of a newly relined furnace. 2. Train all affected employees on the requirements set forth in the procedures. 3. Enforce employee use of the procedures so as to ensure that the refractory is replaced as before a potential hazard arises. .
