ORS654.010 The employer did not furnish a safe place of employment which
was safe and
healthful for employees therein, and did not furnish and use such devices
and safeguards, and
did not adopt or use such practices, means, methods, operations, or
processes as would be
reasonably necessary to render such employment and place of employment,
safe and
healthful, and did not do every other thing reasonably necessary to
protect the life, safety and
health of such employees, as evidenced by;
(1) The 1500 pound walking/working platform that attaches to the Bid-Well
machine, used
for employees to stand on while doing concrete finishing was balanced,
rather than
appropriately secured on a concrete barrier.
(2) The sole brace for the platform, which was approximately 96 feet long,
by approximately
5 feet wide, was a 4x4 piece of lumber positioned at the east end of the
platform in an
unsecured manner.
(3) The sole brace was not guarded against accidental displacement by
pedestrian traffic of
employees working in the area, nor was it secured to the platform, or any
other
appurtenance.
(4) The platform collapsed when the 4x4 was jostled by an employee doing
work in the area,
pinning an employee, and resulting in injuries.
IN THE ALTERNATIVE
OAR437-03-915 During erection, alteration, or repair, structures,
including each part
thereof, shall be braced or guyed as necessary to prevent overturning or
collapse. All
temporary shoring, bracing, or guying used for this purpose shall be
maintained until the
structure or any part of same is otherwise secured against overturning or
collapse.
(a) The employer failed to properly brace the walking/working platform
that attaches to the
paving machine, used for employees to stand on while doing concrete
finishing was balanced,
rather than appropriately secured, on a concrete barrier. The sole brace
for the platform,
which was approximately 96 feet long, by approximately 5 feet wide, was a
4x4 piece of
lumber positioned at the east end of the platform in an unsecured manner.
THIS VIOLATION WAS COMPLIED WITH AT THE TIME OF INSPECTION.
