Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by flying or exploding parts resulting from
the test firing of
partially assembled hand held firearms:
a.Test Range --- The employer did not protect employees from the recognized
hazard of being struck by flying or exploding parts while performing hand
held
test firing of partially assembled weapons such as but not limited to the
Encore
and Contender firearms.
Among other methods, some feasible and acceptable methods to correct this
hazard are:
A.  Implement engineering controls for the test firing room.  Such
controls could include
the use of a mounting fixture(s) which would allow the Contender, Encore,
and
similar
weapons to be mounted and fired without having to be hand held.  Install a
barrier
between the testing employee and the weapon to be fired from the test
fixture.
B.  Develop and implement a test range safety plan that includes (but not
limited to):
Documented training of all employees;  Procedures to be taken in case of
misfires with
the Contender, Encore, and similar weapons; Proper handling of misfire
cartridges;
Emergency phone numbers; Range Cleaning;  Horseplay; Storage of
combustibles;, etc.
