Title 40.1-51.1.(A),Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was riding on the side of a Ford Backhoe, Model 455C as there was no seat available on the machine as it travelled on the roadway of Freemason Street in Norfolk, Va. and was exposed to being run over should the employee fall. "One feasible and acceptable abatement method, among others, to correct this hazard is to adhere to 1926.601(b)(8) Vehicles used to transport employees shall have seats firmly secured and adequate for the number of employees to be carried."
