Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a falling hazard while operating two Crown Stockpickers:
(a)Warehouse: On January 11, 1999, at approximately 2:00 P.M., An employee
was
operating a"Crown" Stockpicker,High Lift Truck, Model #15SP48TT-S, storing
a large chair in a storage rack approximately 25 FT High in the warehouse.
While attempting to put the chair in the storage rack the employee fell
off the
stockpicker landing on the concrete floor below. The Employee was not
using a
safety belt and lanyard nor was any alternative form of fall protection
being used.
Feasible and acceptable methods among others to correct the hazard as
noted in the
Operators safety manual for the Crown Stockpicker.
AS PER CROWN STOCKPICKER TRAINING MANUAL MODEL # 15SP48 :
Before operating Stockpicker, fasten restraining chain, attach safety belt
and tether, place
guard rails in position, and secure pallet, cart or platform to forks.
