Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck during an accident with the truck as required in ASME B56.1-1993: (a)Building #1 - Employee was operating a Yale forklift truck, model #R501, without wearing the provided seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure employees use the seat belts provided when operating forklift trucks. The company was previously cited for a violation of this Occupational Safety and Health Administration Standard which was contained in OSHA Inspection Number 302006374, Citation Number 1,Item Number 1,issued on September 23, 1998. ABATEMENT CERTIFICATION REQUIRED
