Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to non-ionizing radiation not covered under 29 CFR 1910.97: a)On or about 11/5/99, an employee operating equipment was exposed to hazardous non-ionizing radiation, which causes thermal damage to eye and skin. b)On or about 8/28/99, an employee performing maintenance operations was exposed to non-ionizing radiation, which causes thermal damage to eye and skin. The employer had not instituted any measures to control employee exposures to this non-ionizing radiation. Among other methods, one feasible and acceptable method to correct this hazard would be to implement a safety program designed to control all sources of non-ionizing radiation in the workplace, or otherwise prevent or minimize employee exposure to such radiation in accordance with a recognized consensus standard such as those from the American National Standards Institute. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
