Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being pinned under, crushed, or thrown from a forklift truck during an accident with the truck due to not wearing the seat belt provided: as required in ASME B56.1- 1993. (a)Workplace: an employee was operating a Nisson fork truck without wearing a seat belt. Among other methods, one feasible and acceptable abatemant method to correct this hazard is to train employees and ensure employees use the seat belts provided when operating a forklift truck as referenced in ASME.1-1993.
