Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to: engulfment by sand.
(a) Sand Rail Cars Train Area: Employee has to stand on top of sand piles
to shave the
top surface of each pile. Therefore, exposing himself to hazards
associated with confined
spaces.
Among other methods, two feasible and acceptable abatement methods to
correct this
hazard are to:
(1). Use a method to perform the work that does not involve elevating a
person on top
of the sand piles, and
(2). Use of equipment such as vibrators and other equipment that would
completely
remove the sand out of the cars.
OR IN THE ALTERNATIVE OF
29 CFR 1910.146(C)(1): THE EMPLOYER DID NOT EVALUATE THE WORKPLACE
TO DETERMINE IF ANY SPACES WERE PERMIT-REQUIRED CONFINED SPACES:
(a) Sand Rail Cars Train Area: Where employees were required to work in
areas where
engulfment may occur, no evaluations and determinations of the work area
was made to
ensure the employees who were required to stand on top of sand piles and
shave the top
surface of the piles with a shovel were protected from sand engulfment.
