Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees working in the vicinity of the hoists were exposed to the hazards of falling loads, hoists, and their components due to the following conditions: (a)The hoist located at the small paint booth #2 was being operated with kinks in the wire rope cable. (b)The hoists located throughout the plant were being used with the hook tied back while the hook carried a load. One feasible and acceptable method, among others, to correct these hazards is: Establishing a preventative maintenance program, which includes conducting frequent and periodic inspection by a competent person on all hoists and hoist components and support structures with corrective measures taken as needed and as required by ASME B30.10-1993 and ASME B30.16 and 17-1992.
