Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a)The hazard of being crushed by the powered
industrial truck while operating the Toyota truck,
serial number 69974, model number 42-6FGU25, did
not use/wear the installed seat belts.  The
employee operated the Toyota truck on or about
October 30, 2000 in the facility, near the shot
blast.  One feasible and acceptable abatement
method, among others, to correct this hazard would
be to have operators wear the provided seat belt
and enforce the procedure.
