Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by the excavator bucket: (A) On or about May 19, 1999, and at times prior thereto, employees did not follow procedures established by the operator's manual for the JRB coupler in that: (1) Operator did not visually inspect the connection after each bucket change to verify that it was securely attached. (2) Operator did not power down the machine, exit the cab and engage the supplemental lock by hand after each bucket change. Note: Abatement certification and supporting documentation are required for this item.
