Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck/engulfed by gravel:
OR IN THE ALTERNATIVE
29 CFR 1910.176(b): Storage of material shall not create a hazard:
(A)Job Site: On 10 November 1999, and at times prior thereto, the Cat 970F
front end loader operator was exposed to the hazard of gravel collapsing on
him from a gravel stockpile approximately 35 feet in height. The walls were
near vertical and not trimmed to the angle of repose.
ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO
CORRECT THIS HAZARD IS TO:
Trim the stockpile back from the top to obtain the angle of repose.
