40.1-51.1(a) of the Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that a Black & Decker Model 6820 Automotive Series bench grinder, mounted on a pedestal in the center of the Production Area, equipped with one 8"x1" abrasive wheel and one 4"x1" abrasive wheel, had the smaller wheel either so mounted or so worn that it ran at least one-fourth inch out of round, exposing them to the hazard of being struck by wheel fragments in case the out-of-balance wheel should disintegrate. Among other methods, one feasible and acceptable abatement method to correct this hazard is to remove the out-of round, out-of-balance wheel from service as is called for by Section 9.8 of ANSI B7.1-1988, American National Standard Safety requirements for the use, care and protection of abrasive wheels.e
