Section 5(a) (1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment or a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
On or About 4-18-2000, in the Exodus Communication Inc. lot, employees
unloading a tall top
heavy computer rack using a hand pallet jack were exposed to being struck
by the falling rack:
Among other methods, feasible means of correcting the hazard are:
1)  provide the truck with the right size liftgate for the load handled
and fitting the gate
with retention ramp as required by the lift gate manufacturer/s (Waltco
Truck Equipment
Company, Maxon, etc); and
2)  establishing a program and training the employees for proper and safe
handling of the
tall boxes including keeping retention ramp in-place keeping employees
away from under
the load and keeping employees aware where the center of gravity of the
load is.
