Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the counterweight of the excavator. Lisle jobsite. Swing radius of excavator was not marked off. Among feasible means of abatement would be to comply with Bell Land Improvement's Safety Rules and Regulations Manual, The Equipment Manufactures Institute Safety Manual, and; 1. Require that employees mark off swing radius every time an excavator is used. NO CERTIFICATION OR DOCUMENTATION REQUIRED FOR THIS ITEM
