Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. employees were exposed to being struck by the counterweight of the excavator. West of toll booths. Gradall excavator had swing radius unprotected. Among feasible means to abate this condition is to comply with the Safety Manual for Hydraulic Excavators published by the Construction Industry Equipment Association and 1) Barricade and mark the area to prevent contact with the tail swing. NO CERTIFICATION OR DOCUMENTATION REQUIRED FOR THIS ITEM.
