Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to being struck by the counterweight of the excavator. New Haven Street - The swing radius of the John Deere excavator was not marked off. Among feasible means of abatement would be to comply with the Equipment Manufacturer's Institute Safety Manual and 1) require the employees to mark off the swing radius every time the excavator is used. CERTIFICATION REQUIRED FOR THIS ITEM.
