Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being engulfed, struck by shifting or falling ice. a) Icehouse: During the breaking of ice in the icehouse the employee using a metal pole approximately 10 feet long were exposed to the hazard of being struck by shifting and falling ice that could cause death by being buried by the ice or being struck by falling ice. While the ultimate responsibility for correcting the hazards rests with the employer given his knowledge of the operation and having control of his employees working in the ice house, feasible and acceptable methods of abatement include but are not limited to: a) Develop work practices for the employee to eliminate the employee having to climb down a ladder approximately 10 feet to the floor of the ice house with a build up of ice that could fall or shift on the employee that could death or serious bodily harm b) Install a harness/retrieval system inside the icehouse for employees working inside in case they are engulfed, struck by falling and shifting ice. c) Install an automated system to deliver ice to the auger.
