Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  On or
about September 26,
1999 and September 28, 1999, the employer did not furnish employment and a
place of
employment which were free from recognized hazards that were causing or
likely
to cause death
or serious physical harm to employees in that employees were exposed to
struck-by and caught-
in-between hazards. Among others, a feasible and acceptable method to
correct this hazard is
to comply with ANSI B20.1-1976, Safety Standard for Conveyors and other
Equipment,
paragraph 6.14.1.2: Slack cable limit switches shall be provided and so
arranged that whenever
the skip hoisting rope or the counter weight hoisting rope develops slack
or loses tension due
to sticking in the guides, over-travel, or for any other reason, power to
the drive will be cut off
and the brake will be set.
On or about September 26 and 28, 1999, employees worked at the top of the
skip hoist conveyor
system where the slack cable limit switch(es) were located behind the
tensioning arm(s) which
allowed the hoist drums to continue to turn/rotate beyond the
manufacturer's recommended
stopping distance after the skip hoist bucket became jammed in its tracks.
The amount of cable
which was unspooled from the hoist drums allowed the skip hoist bucket to
drop to a level near
the floor in an area which was unguarded from employee exposure, creating
a struck-by hazard.
And, the cables developed pinch-points wherein employees could be caught
in their openings as
the cable was not maintained taut on the drums.

serious physical harm to
employees in that employees allowed to work at the top of the skip hoist
conveyor shaft, 43 feet
above the next lower level, between the skip hoist conveyor winch and the
skip hoist track,
repairing/unjamming the skip hoist conveyor were exposed to a fall hazard.
Among others, a
feasible and acceptable method to correct this hazard is to require the
use of a personal fall
arrest system attached to one of the overhead beams above this area.
