Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the Shuttle Ladle Operators were allowed to transport molten metal from the melt furnace to the pour deck where part of the pathway between the shaker walkway and the pour deck was obstructed by a metal post/support beam. The operators tried to avoid the post by momentarily, stopping then starting, the overhead crane to allow the ladle to swing around it or by slowing the crane speed to allow the ladle to ease past the post. However, since the clearance between the ladle and the post was inadequate, some of the time, the ladle would strike the post. This pathway obstruction potentially exposed employees to a struck-by hazard from a falling/swinging ladle and/or severe burns to their bodies from molten metal splashing/spilling from the ladle. Among others, a feasible and acceptable method to correct this hazard would be to follow the guidelines for transporting molten materials in ladles as given in ANSI Z241.2, Section 6.3.5.2.1, and to provide clearance to allow unobstructed passage of molten metal during its transport. One possible means to provide the necessary clearance includes, but is not limited to, relocating the metal post/support beam approximately 10 to 12 inches back from the walkway.
