Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that they were
exposed to being engulfed by fly ash due to shearing of the sides/edges of
the land fill pit.
a)Alabama Electric Cooperative employee(s) were exposed to potential
engulfment hazards
when operating heavy equipment near the edge of the landfill pit.
Among others, one feasible and acceptable abatement method to correct this
hazard is to
maintain the landfill so that it will support the loads imposed on it
during the
dumping/compaction process.  Such loads may include, but are not limited
to,  dynamic loads
