Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees were exposed to
the hazard of being engulfed by fly ash due to shearing of the sides/edges
of the land fill pit.
a)On or about 10/30/00, employee(s) were exposed to engulfment hazards
when directing
driver(s) of heavy equipment (dump trucks) to the edge of the land fill
pit.
b)   On or about 10/30/00, the side/edges of the land fill pit caved in
when a dump truck drove
to its edge to dump a load of fly ash.
Among others, one feasible and acceptable abatement method to correct this
hazard is to
maintain the landfill so that it will support the loads imposed on it
during the dumping process.
Such loads may include, but are not limited to, dynamic loads such as the
movement of heavy
equipment.
