Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling into the ash pit due to unstable soil surfaces. (a) During the month of November, 2000, the employees were exposed to the hazard of not having transportation out of the woods in the event of an emergency. The employees engaged in logging operations.The work truck that was used to transport the employees back and forth to the worksite, was driven away from the worksite when needed to obtain parts and equipment and/or when the foreman was paged to return to the companys office in Grove Hill, Alabama, which left the remaining crew members without transportation. Among others, one feasible and acceptable method to correct this hazard is to assure that a transport vehicle is always available at the worksite in order to transport employees in the event of an emergency.
