Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling into the ash pit due to unstable soil surfaces. (a) On or about January 23, 2001, a hoist line was used to lift an employee and a load (guy wire) to the communication tower at the same time. Among others, one feasible and acceptable method to correct this hazard is to comply with the Employer's Safety Manual and OSHA Instruction CPL 2-1.29, Interim Inspection Procedures During Communication Tower Construction Activities, dated January 15, 2001. In Section 21.6 of the Employer's Safety Manual, it states, "there shall be no other loads lifted at the same time as personnel." Section 6(f) of CPL 2-1.29 states that when the hoist line is being used to raise or lower employee(s), there shall be no other load attached to any hoist line.
