Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of falling into the ash pit due to
unstable soil
surfaces.
a.At the SL2 filter washing area, employee(s) were operating a Caterpillar
GC45K
SWB forklift truck. The employee(s) routinely climbed and stood on the
elevated
portion of the load (riding the load) in order to attach the load to an
overhead hoist.
Among others, one feasible and acceptable method to correct this hazard is
to comply
with the Caterpillar GC45K SWB Operation & Maintenance Manual, Safety
Rules for
Lift Truck Operators, Page 21, which states: "DO NOT allow any riders!
DON'T
permit riders on the forks or pallet".
OR IN THE ALTERNATIVE
29 CFR 1910.24(b):  Fixed stairs were not provided for access from one
structure level to
another:
a.At the SL2 filter washing area, employees routinely climbed and stood on
the load of
a Caterpillar GC45K SWB forklift in order to access the top portion of the
load.
