Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish
employmnent and a place of employment which were free from recognized
hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
a)Superfresh, Main Floor: The employer did not furnish a place of
employment that was free
from recognized hazards.  The employer had employees performing HVAC work
from scissor
lifts and had failed to protect its employees by covering thirty 2 foot by
2 foot floor holes in
the area.  A similar condition contributed to an accident onsite that
injured two employees of a
separate contractor when the employees drove the vehicle into the floor
hole, tipping the
scissor lift.
One method of abatement would be to cover all floor holes or to maintain a
safe working distance
from obstacles, debris, drop-offs, holes, depressions, ramps and other
hazards to ensure safe elevated
travel as per ANSI A92.6-1990 Section 8.10.15.
