North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to a crushing hazard:
The supporting structure, including trolleys, monorail, or crane,
if any, were not designed to withstand the loads and forces imposed
by the hoist (ref. ANSI B30.16-1981 Sec. 16-1.3.2);
The load chain was not proof tested by the chain or hoist
manufacturer with a load at least equivalent to 1-1/2 times the
hoist's rated load divided by the number of chain parts supporting
the load (ref. ANSI B30.16-1981 Sec. 16-1.2.8(b);
The manufacturer did not furnish an instruction manual with each
hoist (ref. ANSI B30.16-1981 Sec. 16-1.2.17);
Prior to initial use, all new, altered, or modified hoists were not
inspected by a designated person to ensure compliance with the
applicable provisions of this standard (ref. ANSI B30.16-1981 Sec.
16-2.1.1(a);
Frequent visual examinations by the operator or other designated
personnel, with records not required, were not performed on a
monthly basis for hoists used under normal service (ANSI B30.16-
1981 Sec. 16-2.1.1(b)(1);
Periodic visual inspection by appointed person, who makes records
of apparent external conditions, was not performed annually for
hoists used under normal service, to provide the basis for a
continuing evaluation (ref. ANSI B30.16-1981 Sec. 16-2.1.1(b)(2):
a)warehouse loading area and shop - employees using a CM, series
622, 1 ton overhead, hand chain operated, chain hoists,
mounted on a 4 x 4 inch, 45 ft. steel I-beam, welded onto
prefabricated building supports, to lift 200-400 lb.
automobile engines.
One feasible and acceptable abatement method, among
others, to correct this hazard is to have a registered
engineer or certified hoist inspector to load rate the I-
beam and supporting structures; proof test load chain;
obtain instruction manual from manufacturer or supplier;
have hoists inspected by designated person to ensure
compliance with applicable provisions of this standard;
perform frequent and periodic inspections of hoists.
