and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:  structural failure of the ladder.
a.site - employee posting bills while using a 16 ft.
fiberglass Formetco Posting Ladder at heights varying
from approximately 35-57 ft. above the ground with a
damaged rung - rung, second from the bottom had a split
approximately 5 1/2 in. long between the side rails.
Among other methods, one feasible and acceptable abatement
method to correct this hazard would be to inspect and remove
from service per the manufacturer's instructions.
