North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: extremely hot water that could result in severe burn to hand and/or other parts of body during use. a)facility, kitchen area (washing facilities) - hazard exist for employees to receive severe burn(s) during use hot water at washing facilities in kitchen area, water temperature was in excess of 180 degrees. Employer allowed thermostat setting to remain at 180 degree for hot water heater unit (State Sand Blasting, Self Cleaning, 70 gallon capacity gas unit). One feasible and acceptable method of abatement is to ensure thermostat setting is maintained at temperature of not more than 140 degrees in accordance with guidelines established by local health department (located in Rocky Mount, NC)nt,
