North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: load release that would subject employees to falling overhead material hazards. a)Jobsite, skid steer loader - where employee was atop the ROPS and elevated lift arm of the loader and was struck by the unexpected release of an elevated load in the bucket resulting in a jobsite accident on 03/30/99. A reasonable and feasible means of abatement would be the prohibition of employee work from that position by management.!
