North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to a crushing hazard:
The supporting structure, including trolleys, monorail, or crane,
if any, were not designed to withstand the loads and forces imposed
by the hoist (ref. ANSI B30.16-1981 Sec. 16-1.3.2);
The load chain was not proof tested by the chain or hoist
manufacturer with a load at least equivalent to 1-1/2 times the
hoist's rated load divided by the number of chain parts supporting
the load (ref. ANSI B30.16-1981 Sec. 16-1.2.8(b);
Frequent visual examinations by the operator or other designated
personnel, with records not required, were not performed on a
monthly basis for hoists used under normal service (ANSI B30.16-
1981 Sec. 16-2.1.1(b)(1);
Periodic visual inspection by appointed person, who makes records
of apparent external conditions, was not performed annually for
hoists used under normal service, to provide the basis for a
continuing evaluation (ref. ANSI B30.16-1981 Sec. 16-2.1.1(b)(2):
a)building 2 - two, manual chain hoist, 1 HS Type, 3 ton hoist
and one 1.5 ton hoist, mounted on a 6 x 6 inch, 12 ft. I-Beam,
with a 2 ton trolley.  The I-beam was welded onto 2 vertical
support posts, to lift front half of boats, approximately 2',
weighing approximately 3800 lbs, on and off trailers.  The I-
beams was not load rated.
b)building 2 - two, manual chain hoist, 2 HS Type, 3 ton hoists
were mounted on a 6 x 12 inch, 12 ft. I-Beam, with two, 2 ton
trolleys.  The I-beam was welded onto 2 vertical support
posts, to lift back half of boats, approximately 2', weighing
approximately 3800 lbs, on and off trailers.  The I-beams was
not load rated.
One feasible and acceptable abatement method, among
others, to correct this hazard is to have a registered
engineer or certified hoist inspector to load rate the I-
beam and supporting structures; proof test load chain;
have hoists inspected by designated person to ensure
compliance with applicable provisions of this standard;
perform frequent and periodic inspections of hoists.
