North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
Ref:ANSI B30.11-2.2.2  Rated Load Test
(a)establishment, monorails throughout facility had not been
load tested prior to initial use by employees.
(b)establishment, jib cranes throughout the facility had not
been load tested prior to initial use by employees.
(c)establishment, under hung cranes throughout the facility
had not been load tested prior to initial use by
employees.
Note:Among other methods, one feasible and
acceptable abatement method to correct
this hazard is to have all monorails, jib
cranes and underhung cranes load tested.
