North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)jobsite, at sanctuary structure; employee working on an
elevated work platform supported by a motorized forklift
without the pallet/platform being secured to lift forks
to prevent movement or falling, exposing a 7' fall hazard
to employee.
b)jobsite, at sanctuary structure; employee working on an
elevated work platform supported by a motorized forklift,
without guardrails, midrails, or toe boards on all open
sides, exposing employee to 7' fall hazard.
c)jobsite, at sanctuary structure; employee working on an
elevated work platform supported by a motorized forklift,
without a slip/trip preventive surface.ve
