North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)facility; shop - a load test has not been conducted on
the 2 Ton Harrington Underhung crane.
Reference:ANSI B30.11-1980; paragraph 11-2.2.2(a) -
Rated Load Test - Prior to initial use , all
cranes shall be load tested.
Note:Among other methods, one feasible and acceptable
abatement method to correct this hazard is to
conduct a load test.

Initial Inspection - before use, all new and
altered cranes shall be inspected, then
followed by frequent and periodic inspections.
Note:Among other methods, one feasible and acceptable
method to correct this hazard is to conduct the
inspections and to continue inspections monthly,
periodically and frequently supported by
documentation.

to initial use.
