employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: (a) The hazard of being struck by escaping high pressure
steam and water and
shrapnel from the over pressuring of the unit due to the removal of the
pressure relief valve
which allowed the boiler to build up to approximately 80 pounds of
pressure before it exploded.
Among other methods, feasible and acceptable abatement methods to correct
this hazard is to
establish and enforce those procedures, stipulated by the ASME Boiler and
Pressure Vessel code
Section VI 1998.
