Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees delivering low permeable materials to the landfill were exposed to the hazards of crushing injury from side by side end dumping: On or about June 28, 2000, approximately one mile from the weigh station, employees were exposed to the hazard of being crushed by a truck, parked approximately three feet away, performing side by side dumping in an area where only one dump zone had been set up by the site employer. Among other methods, one feasible and acceptable abatement method to correct this hazard is to survey all locations where employees will be delivering material to assure adequate dumping zones are available for the number of trucks arriving daily. Prohibit all side by side dumping and set up a way to stop trucks that pull up next to each other. Restrict the delivery of overloaded trucks. Train all employees in the safe methods of delivering and dumping materials at landfills, such as but not limited to, training provided by Mine Safety Association. Assure that all contractors delivering to the landfill have a safety and health program which includes safe methods of delivering and dumping material at landfills. Document and enforce all steps of the above or of an equivalent program used to safeguard employees and delivering drivers.
