Section 5(a)(1) of the OSHAct of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Jobsite: Propane torch heating was done on a manhole cover in the presence of flammable gases, without prior testing to ensure their absence. Feasible means of abatement include, but are not limited to, ensuring there are no flammable gases in the vicinity of propane torch heating by testing for their presence prior to heating.
