Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard created by the sudden and unpredictable descent of vehicles elevated by automotive lifts: a)In the shop, Bay 1, on or about 7/22/99: VBM surface-mounted automotive lift, no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. b)In the shop, Bay 2, on or about 7/22/99: VBM surface-mounted automotive lift, three of the contact pads on the arms could not be adjusted and no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. c)In the shop, Bay 3, on or about 7/22/99: Forward Surface 8000A surface- mounted automotive lift, no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. d)In the shop, Bay 4, on or about 7/22/99: Globe two piston automotive lift, had no functional locking devices, had hydraulic leaks, there were no markings on the lift indicating manufacturer's name, rated load capacity, model and serial number, and no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. e)In the shop, Bay 5, on or about 7/22/99: Globe two piston automotive lift, had no functional locking devices, had hydraulic leaks, there were no markings on the lift indicating manufacturer's name, rated load capacity, model and serial number, and no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. f)In the shop, Bay 6, on or about 7/22/99: Surface-mounted automotive lift, no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. g)In the shop, Truck Bay, south end, on or about 7/22/99: Axle-engaging two piston lift had no functional locking devices, had hydraulic leaks, the floor lift control mechanisms were loose, damaged and not aligning properly with the pin devices below the floor, had no markings on the lift indicating manufacturer's name, rated load capacity, model and serial number and no periodic inspections were conducted on the lift, exposing employees the being struck by the vehicle should the lift fail. h)In the shop, Truck Bay, north end, on or about 7/22/99: Axle-engaging two piston lift had no functional locking devices, had hydraulic leaks, the floor lift control mechanisms were loose, damaged and not aligning properly withthe pin devices below the floor, had no markings on the lift indicating the manufacturer's name, rated load capacity, model and serial number and no periodic inspections were conducted on the lift, exposing employees to being struck by the vehicle should the lift fail. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1.Install and/or repair mechanical locking devices. 2.Repair hydraulic leaks. 3.Repair floor lift control mechanisms. 4.Install permanent markings on the lifts to show the manufacturer's name, rated load capacity, model and serial number. 5.Establish a periodic inspection procedure as recommended by the manufacturer to ensure the safe operation of the lift. 6.Instruct all employees in the safe use and operation of the automotive lifts and their safety devices and ensure their routine use. Abatement documentation must be submitted for this item.
