Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD SHOULD THE OVERHEAD HOIST OR SUPPORTING STRUCTURE FAIL: a)Wall line, on or about 12/17/00: Supporting structure for overhead hoist was not designed for the loads and forces imposed by the rated load. b)Wall line, on or about 12/17/00: Hoist system and support structure was not load tested. Among other methods one feasible and acceptable method of abatement is to have the hoist structure approved by an engineer, and perform load tests of the structure. Abatement certification must be submitted for this item.
