Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE FALLING LOAD: a)Throughout the work place, on or about 5/25/01: Overhead hoist used for lifting materials including but not limited to; dies, metal plates. 1)Hoist and support structures were not being inspected on a frequent and periodic basis. 2)Support structure and monorail were not marked with the rated load capacity. ABATEMENT NOTES: Among other methods, one feasible method of abatement is to: 1). Conduct frequent and periodic inspections of the hoists and support structures for wear, deterioration and malfunction as per ASME B30.16-1987. 2). Load rate the support structures for the hoists system as per ASME B30.16-1987. Abatement certification must be submitted for this item.
