Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE FALLING LOAD: a)Donut fryer and Make up areas, on or about 05/01/01: Overhead hoist used for lifting materials including but not limited to: mixed ingredients. 1)Hoist was not being inspected on a frequent and periodic basis. 2)Support structures and monorails were not marked with rated load capacity markings. 3)Safety clip on battery room hoist was broken. ABATEMENT NOTES: Among other methods, one feasible method of abatement is to: 1) Conduct frequent and periodic inspections of the electric hoist for wear, deterioration and malfunction as per ASME B30.16-1987. 2) Request a qualified person to inspect the support structure for the hoist system as per ASME B30.16-1987. 3) Replace broken safety clip on hook. b)Donut fryer, on or about 05/01/01: Below the hook lifting device was not being inspected on a frequent and periodic basis, and was not marked with the rated capacity. ABATEMENT NOTES: Among other methods, one feasible method of abatement is to: Conduct frequent and periodic inspections in accordance with ASME B30.20-1993, and mark rated load capacity on the below the hook device. Abatement certification must be submitted for these items.
