Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed. (a)Worksite - Employee was observed riding inside of a Komatsu excavator bucket approximately 15ft high while working on a sewer line trench; On or about 10/05/99. ABATEMENT NOTES: A.Follow the Society of Automotive Engineers (SAE) Recommended Practice entitled "Safety Considerations for the Operator - SAE J153": Among other methods, one feasible method to reduce the hazard is to: 1.Do not permit riders on the machine. B.Use an access ladder to get into and out of a trench. ABATEMENT VERIFICATION IS NOT REQUIRED AS OUTLINED IN PART 29 CFR 1903.19
