Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being ejected from a self propelled boom supported platform: (a)At the worksite - An employee engaged in caulking seams on the facade of the building facade was not protected from being ejected from a MARKLIFT self propelled boom. The employee was working at a height of approximately 35 feet; on or about 08/17/00. ABATEMENT VERIFICATION IS NOT REQUIRED AS OUTLINED IN PART 29 CFR 1903.19
