Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards associated with an uninspected special purpose
personnel elevator:
The special purpose personnel elevator located in the grain elevator had
not been inspected in
accordance with the frequencies prescribed by the American Society of
Mechanical Engineers
in Safety Code for Elevators and Escalators, ASME A17.1-1996.
ASME A17.1-1996 requires routine inspections and tests of this elevator at
intervals not longer
than six months and periodic inspections and tests of this elevator at
intervals not longer than
one year.  The elevator had not been inspected since October 13, 1998,
representing a period
of almost eighteen months.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
Ensure that inspection of special purpose personnel elevator occurs at
intervals required
by ASME A17.1.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
complete.
