Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevation and/or entanglement in an operating conveyor belt: a)Roofing Supply of Colorado, Inc., & 1213 Spring Creek Road, Dillon, CO: On or before 04-27-98 employees utilized the elevated mobile conveyor to gain access to and from rooftops, which they were stocking with shingles. Personnel riding the conveyor is expressly prohibited by ASME B20.1-1996 Safety Standard for Conveyors and Related Equipment. Condition exposes employees to the hazard of falling from an elevation and/or becoming entangled or entrapped in the operating conveyor belt. Among other methods, one feasible and acceptable abatement method to correct the hazard is to utilize a portable ladder to access the rooftops. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
