Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while riding the boom of a rough terrain forklift: a) Contreras Carpentry & E470 between Exit 31 and Toll Booth D, Denver, CO: On or before 09-22-99 the employer failed to follow the guidelines established by ASME/ANSI B56.6c-1991, Sec. 5.15, for elevating personnel using a rough terrain forklift. An employee was observed riding the boom of a CAT model TH63 rough terrain forklift (SN 5W14002920) up to height of approximately 45 feet. Among other methods, one feasible and acceptable abatement method to correct the hazard is to use an approved manbasket that meets the requirements of of ASME/ANSI B56.6c-1991. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
