Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee, in that the employees were exposed to : (a) falls from approximately 20 feet while working on an unsecured, unguarded plywood trash collection box that had been raised in place by the forks of a "Catipiller" forklift. Among other methods, one feasible means of abatement to correct this hazard is to design and build a safety platform as stated in ANSI B56.1-1988, Safety Standard for Low Lift and High Lift Trucks, Part II, Section 4.17. Abatement Note: Abatement certification is not required for this item.
