Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards from an elevated personnel platform:
a)  W.A.G.S. Construction, Inc. & Highway 34 and 71st Ave., Greeley, CO:
On or
before May 2, 2000, the employer did not ensure that a wooden, job-made
personnel
platform used by employees in conjunction with a rough-terrain forklift,
was properly
designed, constructed, utilized and maintained. An employee was working
approximately 15 feet off of the ground using this arrangement.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to design, construct, utilize, and maintain the personnel
platform in
accordance with ASME/ANSI B56.6-1987, Safety Standard for Rough Terrain
Forklift Trucks.
